PM Technologies Corporation ("Company," "we," or "us") is committed to protecting your privacy.

This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you use our platform and custody-operations services. This policy is designed to comply with the California Online Privacy Protection Act (CalOPPA) and, where applicable, the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA).


1. Our Role

We may collect personal information (a) directly from visitors and users of our Platform Services, and (b) as a service provider or contractor processing personal information on behalf of Customer (the Trust Company or custodian).

Where we act as a service provider or contractor, we process personal information only for the purposes specified in our contract with Customer and do not sell or share such information.


2. Information We Collect

We collect the following categories of personal information, depending on how you interact with our services:

Identifiers: name, email, phone number, user IDs, portal tokens.

Commercial information: billing records, invoices, service tier, fee history.

Internet or network activity: IP address, device identifiers, browser type, access logs, timestamps.

Shipment and contact details: addresses, carrier data, tracking numbers.

Asset-related data: item descriptions, serial numbers, weights, declared values, bin locations.

Security and integrity signals: authentication logs, fraud detection data, risk scoring.


3. How We Use Your Information

We use personal information to:

Provide and maintain Platform Services.

Manage custody operations including intake, inventory, and shipments.

Process transactions and billing.

Authenticate users and prevent fraud.

Maintain audit trails for custody chain-of-evidence.

Provide customer support.

Comply with legal obligations.

Improve our platform.

We use information only as reasonably necessary and proportionate to each disclosed purpose.


4. Information Sharing

We may share your information with:

Service providers who assist in our operations (such as payment processors, shipping carriers, and cloud infrastructure providers), subject to contractual restrictions on use and disclosure.

Law enforcement or regulatory authorities when required by law, subpoena, or court order.

Parties necessary to protect our rights, safety, or property.

For Beneficiary or End Client information processed on behalf of a Trust Company or custodian Customer, information is shared only with the Customer that manages their account and its authorized agents.


5. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information, including:

Encryption in transit and at rest.

Role-based access controls.

Audit logging and access monitoring.

No method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.


6. Data Retention

We retain personal information for the period reasonably necessary for each disclosed purpose:

Account and billing records: retained for the duration of the account relationship plus seven (7) years for tax and legal compliance.

Security logs and audit trail records: retained for seven (7) years to support custody chain-of-evidence requirements.

Shipment records: retained for five (5) years.

If we cannot specify a fixed period, we apply criteria based on the nature of the data, legal requirements, and business necessity. We do not retain personal information longer than reasonably necessary for the purposes disclosed.


7. Your California Privacy Rights

If you are a California resident, you may have rights under the CCPA/CPRA to:

Request access to or disclosure of the categories and specific pieces of personal information we have collected about you.

Request deletion of your personal information, subject to certain exceptions.

Request correction of inaccurate personal information.

Opt out of the sale or sharing of personal information.

Limit the use of sensitive personal information to permitted purposes.

Not be discriminated against for exercising your rights.

We will respond to verifiable requests within forty-five (45) days, with one forty-five (45) day extension when reasonably necessary.


8. Service Provider Routing

Where we process information as a service provider or contractor on behalf of a Customer, we may route your privacy request to the Customer business controlling the relationship.

We will assist the Customer in responding to verifiable consumer requests as required by law.


9. Cookies and Do Not Track

We use cookies and similar technologies for session management, security, fraud prevention, and analytics.

You can control cookie settings through your browser; disabling cookies may affect platform functionality.

We do not currently respond to Do Not Track browser signals. We do not authorize third parties to collect personally identifiable information about your online activities across different websites when you use our Platform Services.


10. Sale and Sharing of Personal Information

We do not sell personal information.

We do not share personal information for cross-context behavioral advertising purposes.

If our practices change, we will provide a "Do Not Sell or Share My Personal Information" link and process opt-out preference signals consistent with applicable law.


11. Breach Notification

We maintain an incident response plan and will provide breach notifications as required by California law.

In the event of a data breach affecting your personal information, we will notify you within the timeframes and in the manner required by applicable law.


12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our platform and updating the "Last Updated" date.

Material changes will be highlighted for thirty (30) days following posting.


13. Governing Law

This Privacy Policy shall be governed by the laws of the State of California.
